HOLDINGS: [1]-A short story writer’s contract and fiduciary duty claims against defendants, a director and a film production company, in his idea submission case failed because the 12 elements that the writer claimed were added to defendants’ film beyond the director’s original script-length treatment were not substantially similar to elements in the writer’s story as a matter of law, and he thus failed to prove that defendants used his ideas for the film; [2]-The writer’s fraud claims against defendants failed because he offered no evidence supporting an inference that they made any intentional misrepresentations or false promises and also failed to offer any evidence of resulting harm.
